Donald J. Weiss graduated from St. John's University Law School in 1979. He worked for a small boutique firm until 1981, when he became a trial counsel for a law firm representing an automobile insurance company. His experience working with the insurance company made him keenly aware of how to protect your interests when you are injured. Mr. Weiss left to start his practice in 1983, when he partnered with a former Special Assistant US Attorney for the Immigration and Naturalization Services. Since then, he has maintained the Law Office of Donald J. Weiss to help his clients with all types of legal matters.

In 2011, Donald partnered with Howard M. Rosengarten to create the law firm of Rosengarten & Weiss for the purpose of representing the disabled.

Mr. Weiss has a close friend who depends on a wheelchair for mobility. Don's friend has battled MS for many years and Don has shared in the disappointments and frustrations encountered by his friend and his family. It was heartbreaking to watch his friend keep his good attitude and try so hard to fight to overcome his personal challenges, only to be knocked down by a trip out into the city because of the physical barriers he encountered. As his friend became dependent on his wheelchair more and more over the years, Don saw firsthand how many places became inaccessible to him that he had previously enjoyed. When he went to buy a bike as a birthday gift for his niece he could not get in and the anticipated joy became disappointment.

Mr. Weiss came to realize how few attorneys are willing to help the disabled file a claim under the ADA to force businesses to become accessible. When he moved his office from Brooklyn into Manhattan, he relocated into the office space of Howard Rosengarten and together they found that they shared a common concern for the plight of the disabled in New York City. In 2011, they decided to form a partnership with the sole goal of helping the disabled fight for their rights.

Don’s personal relationship with a wheelchair bound individual helped convince him to investigate and, subsequently, commence litigation under the ADA, securing access and monetary damages for his clients.

 

 

Howard M. Rosengarten started his law firm in 1968 with a focus on immigration and injury law. Over the years he began helping his clients with all their needs as they arose, and became skilled in divorce and family law as well as bankruptcy. He strives to build a relationship with his clients. Today he handles the children and grandchildren of many of the clients who helped him build his practice. Howard’s office has attorneys to handle all of your needs, including landlord tenant, claims under the ADA, injuries at work, getting you your social security, criminal defense and any other legal problem you encounter.

Howard has been a member of the American Immigration Lawyers Association since 1969, and has conducted seminars and spoken on many legal subjects. He enjoys discussing real people’s everyday issues and helping them find solutions. He offers a free consultation and often helps people find hope again to overcome a situation which seemed hopeless. It is this process which led Howard into the business of handling ADA cases. A client in a wheelchair who came in for a free consultation for a divorce mentioned how frustrating it was that she couldn't get into stores and restaurants often. She told Howard that she often went on an outing to a particular large store with other people where she lives. However, she could do nothing more than sit in the van while other people did her shopping due to a step down inside the store. Howard remembered the frustration and depressed feelings his mother had in the same situation so he offered to help his client. They now have a ramp inside the store.

Very shortly thereafter Howard and his partner, Donald J. Weiss, filed a lawsuit in Federal court to force the store to stop breaking the law. A ramp was installed and his client now is able to fully enjoy the outings with her friends. In addition, Howard was able to get compensation for his client for the negative ways the situation had impacted her! Best of all, there was no charge to his client!! The ADA provides that the businesses BREAKING THE LAW must pay for the attorneys services.

His disabled clients have been assisted with claims against the facilities which caused their bedsores due to bad care. He assists with SSI claims for the disabled who have been denied. In addition to his regular clients, many other attorneys regularly seek his advice. Howards years of helping his clients has made him well versed to assist the disabled with ALL of their legal problems and looks forward to helping you!
